Welcome to CapCart: AI Grocery Tracker. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and Neon Grain Studio ("Neon Grain", "we", "us", or "our") governing your access to and use of the CapCart mobile application and associated services (collectively, the "Service").

By downloading, installing, accessing, or using CapCart, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the application.

1. Purpose and Nature of the Service

CapCart is an informational in-store shopping cart tally, price tag scanner, and grocery budget management tool.

• Personal Estimation Tool: CapCart is intended to help you estimate grocery totals, organize cart items into categories, and track spending progress against a self-imposed trip budget.
• Not Official Point-of-Sale (POS): CapCart is not affiliated with, endorsed by, or integrated into the point-of-sale or register systems of any grocery retailer, supermarket chain, or store. The final price payable at checkout is determined exclusively by the merchant register, receipt, local taxes, bottle deposits, and retailer discounts.
• No Financial or Legal Advice: Budget indicators and spending warnings are provided solely for personal organizational convenience and do not constitute certified accounting, financial planning, or tax calculation advice.

2. AI Scanning & Optical Recognition Disclaimer

CapCart utilizes optical image scanning and machine learning AI models to detect and extract item names, prices, and categories from shelf labels:

• Recognition Accuracy: While CapCart strives for high accuracy, AI vision extraction may produce errors due to poor lighting, reflections, distorted shelf tags, handwritten labels, multi-item tags, unit-pricing confusion (e.g. per pound vs. per piece), or currency discrepancies.
• User Verification Responsibility: You are solely responsible for reviewing and confirming the scanned item name, unit price, and item quantity on the confirmation sheet before adding the item to your active shopping cart. Neon Grain Studio is not liable for discrepancies between scanned prices and register checkout prices.

3. Camera and Device Usage

When using camera scanning features in retail environments, you agree to:

• Comply with all retail store policies and guidelines regarding mobile phone and photography usage on commercial premises.
• Exercise reasonable situational awareness and avoid walking into aisles, obstacles, or other patrons while operating the camera viewfinder.
• Use the Service in compliance with all applicable local, regional, and federal laws.

4. Intellectual Property

The Service, including its UI design, code, graphics, branding, icons, workflows, and compilation, is the exclusive intellectual property of Neon Grain Studio and is protected by copyright, trademark, and other applicable laws.

Subject to your compliance with these Terms, Neon Grain grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use CapCart for personal, non-commercial purposes on compatible devices that you own or control.

5. User Data and Local Storage

CapCart stores shopping trips, logs, and preference settings locally on your device. You are responsible for maintaining the security of your device. Neon Grain Studio does not maintain backups of your local trip logs and cannot restore lost data if you uninstall the application or wipe your device storage.

6. Disclaimer of Warranties ("AS IS")

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NEON GRAIN STUDIO DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) AI RECOGNITION OR PRICE CALCULATIONS WILL BE 100% ACCURATE; (C) DEFECTS WILL BE IMMEDIATELY CORRECTED; OR (D) THE SERVICE IS FREE OF BUGS OR HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEON GRAIN STUDIO, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, OVERSPENDING AT CHECKOUT, LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.

8. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our discretion. The most current version will always be posted on this page with an updated "Last updated" date. Continued use of CapCart after any modifications constitutes your acceptance of the revised Terms.
